Agreement
Applications for the use of school facilities, indoors or outside, are issued to an individual for an organization or group. The individual to whom the approved application is issued shall supervise all participants in the activity, and be responsible for the proper use of the facility. If the activity is school sponsored, this individual must be a member of the Tapestry Charter School faculty or staff.
The School Attendant will be designated. In most cases, this will be the head custodian of that building, with responsibility for the security and supervision of the physical plant, i.e. locking and unlocking doors and reasonable custodial services. The custodian has final responsibility for maintaining building security before and after the activity. Access to the building will be provided ONLY during the hours stated. The custodian is NOT responsible for supervision of the activity or participants.
Groups and organizations given the privilege of the use of the facilities of the school are expected to leave the facility in reasonably good order.
Copies of this permit are distributed to the custodian/or engineer and will be sufficient, in most instances, to assure custodian, janitorial and heating services appropriate to the needs of the activity.
The following regulations have been established by Tapestry Charter School:
• The signer of the application shall be the responsible representative of the organization in all dealings with the Tapestry Charter School or its agents, with respect to any application, and shall be on hand whenever the facilities are used under such permit, unless Tapestry Charter School shall have notice in advance that another will serve in his/her place.
• The organization shall indemnify the Tapestry Charter School for all claims, losses or liability suffered by any person using the facilities under this permit, to the fullest extent of the law.
• An officially designated agent of Tapestry Charter School shall be in charge of the building whenever the premises are in use by others. He/She shall have authority to make final decisions on all questions not otherwise covered.
• Fees will depend upon facilities and personnel required. The applicant must be responsible for payment for any damage to building or equipment, in addition to the fee. No mechanical equipment or structural material is to be brought into the building or onto the school grounds, or connected with the electrical service, without the specific permission of the Chief Operations Officer.
• Smoking is NOT permitted at any time on school property. The use of open flames, such as candles, is NOT allowed. NO alcoholic beverages may be brought onto the premises. The sponsor is responsible to limit attendance to the safe capacity of any room or facility. The privilege of parking on the premises shall be subject to the regulations of the Tapestry Charter School and the off-street parking rules of the City of Buffalo. Official attendants shall have full authority to enforce parking regulations.
Health Risk Clause:
The applicant is responsible for reviewing, understanding and disseminating safety information to all participates in attendance.
1. Contact the building health professional for any safety or known health concerns, which includes accommodations for allergies such as latex and nuts, prior to facility usage. Information on managing health concerns will be provided upon request.
2. Automated External Defibrillators (AEDs) are located in each building for emergencies. It is the applicants responsibility to know the location of the AED prior to facility use. The AED should be brought to the location of an unconscious person and 911 emergency medical services contacted.
3. The building custodian must be informed of any emergency, health, or safety concern during building usage, including any blood or body fluid spill for proper clean-up and disinfection.
4. New York State Education Law and School Policy prohibits any tobacco use on school property (including all vehicles) at all times.
I hereby agree to use ONLY the above-related facilities and to be responsible for the proper use of such facilities in accordance with all rules and, if necessary, to pay the cost of services required to make these facilities available for use. The applicant shall be the agent of the organization for further negotiations.
